TERMS AND CONDITIONS OF THE ONLINE STORE SKLEP.WIKING.TECH
1. GENERAL PROVISIONS
1.1. The Online Store available at www.sklep.wiking.tech is operated by WikingTech Damian Gendig, place of business and address for service: Polanów 76-010, ul. Gradowe Wzgórze 30, Poland, NIP (Tax ID): 4990017130, REGON: 331363404, e-mail address: biuro@wiking.tech, phone number: +48 668664573.
1.2. These Terms and Conditions define the rules for using the Online Store, including the rules for concluding Sales Agreements, complaint procedures, and withdrawal from the contract.
1.3. The Controller of personal data processed in connection with the implementation of these Terms and Conditions is the Service Provider.
1.4. The designated point of contact for Member States' authorities (in accordance with the Digital Services Act - DSA) and for Users is the e-mail address: biuro@wiking.tech. Communication is conducted in Polish and English.
1.5. Definitions:
- WORKING DAY – one day from Monday to Friday, excluding public holidays in Poland.
- ORDER FORM – an interactive form available in the Store enabling the placement of an Order.
- CUSTOMER – (1) Consumer; (2) Entrepreneur; (3) Entrepreneur with Consumer Rights.
- CONSUMER – a natural person performing a legal transaction with an entrepreneur not directly related to their business or professional activity.
- ENTREPRENEUR WITH CONSUMER RIGHTS – a natural person concluding a contract directly related to their business activity, when the content of this contract shows that it does not have a professional nature for that person (arising in particular from the subject of their business activity).
- PRODUCT – a movable item available in the Store which is the subject of the Sales Agreement.
- SELLER – WikingTech Damian Gendig (details as in point 1.1).
- SALES AGREEMENT – a contract for the sale of a Product concluded between the Customer and the Seller via the Online Store.
- CONSUMER RIGHTS ACT – the Act of 30 May 2014 on Consumer Rights (Poland).
2. ELECTRONIC SERVICES
2.1. The following Electronic Services are available in the Store free of charge: Account, Order Form, and Newsletter.
2.2. Account – a service provided for an indefinite period. The Service Recipient may delete the Account at any time by sending a request to the Seller.
2.3. Newsletter – a service provided for an indefinite period. Subscription requires providing an e-mail address and giving consent. Resignation is possible at any time via the link in the e-mail or by contacting the Seller.
2.4. Technical requirements: a device with Internet access, a web browser supporting cookies and JavaScript, an active e-mail account.
2.5. It is prohibited for the Service Recipient to provide unlawful content.
3. CONDITIONS FOR CONCLUDING A SALES AGREEMENT
3.1. Product prices shown in the Store are gross prices (including VAT) and are expressed in Polish Zlotys (PLN).
3.2. The total price including delivery costs is displayed in the Order summary before its final confirmation (button "Order with obligation to pay").
3.3. Price Information (Omnibus): In the event of a price reduction announcement, the Seller provides the lowest price of the product from the period of 30 days prior to the introduction of the reduction next to the current price.
3.4. The conclusion of the Sales Agreement occurs when the Customer receives an e-mail confirmation of the Order acceptance for execution.
4. PAYMENTS
4.1. The Seller provides the following payment methods:
- 4.1.1. Cash on Delivery (payment upon receipt of the shipment).
- 4.1.2. Cash upon personal collection.
- 4.1.3. Bank transfer to the account: PKO B.P. No. 95 1020 4900 0000 8402 3073 8856.
- 4.1.4. Electronic payments and credit card payments via PayU.pl.
4.2. The payment deadline for bank transfers and online payments is 7 calendar days from the date of concluding the Agreement.
5. DELIVERY
5.1. Product delivery is carried out within the territory of the Republic of Poland.
5.2. Delivery costs are transparent and indicated during the Order placement process.
5.3. Available delivery methods: Postal shipment, Courier shipment, Personal collection (ul. Gradowe Wzgórze 30, 76-010 Polanów, Poland, on Working Days 09:00–17:00).
5.4. The delivery time is up to 7 Working Days (usually shorter, as indicated on the product page).
6. COMPLAINTS AND LACK OF CONFORMITY (CONSUMERS)
This section applies exclusively to Customers who are Consumers or Entrepreneurs with Consumer Rights.
6.1. The Seller is liable for the lack of conformity of the goods with the contract existing at the time of delivery and revealed within two years from that time, in accordance with the provisions of the Consumer Rights Act.
6.2. If the goods are not in conformity with the contract, the Consumer may request repair or replacement.
6.3. If repair and replacement are impossible or would require excessive costs, the Seller may refuse to bring the goods into conformity with the contract.
6.4. The Consumer may submit a statement of price reduction or withdrawal from the contract if:
- The Seller refused to bring the goods into conformity with the contract;
- The Seller failed to bring the goods into conformity with the contract;
- The lack of conformity of the goods with the contract continues despite the Seller having attempted to bring the goods into conformity;
- The lack of conformity of the goods with the contract is significant enough to justify an immediate price reduction or withdrawal from the contract.
6.5. Complaints may be submitted:
- In writing: WikingTech, ul. Gradowe Wzgórze 30, 76-010 Polanów, Poland.
- Electronically: biuro@wiking.tech.
6.6. The Seller shall respond to the complaint within 14 days.
7. RIGHT OF WITHDRAWAL (RETURNS)
Applies to Consumers and Entrepreneurs with Consumer Rights.
7.1. The Consumer may withdraw from the Sales Agreement within 14 days without giving any reason.
7.2. The period begins from the moment the Consumer takes possession of the Product.
7.3. To withdraw from the agreement, a statement must be submitted (e.g., via e-mail to biuro@wiking.tech or in writing). The statutory model withdrawal form may be used, but it is not mandatory.
7.4. Refund: The Seller shall refund all payments made by the Consumer, including delivery costs (with the exception of additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest standard delivery method available in the Store), immediately, no later than within 14 days.
7.5. The Seller may withhold the reimbursement until receipt of the Product back or until the Consumer has supplied evidence of having sent back the Product.
7.6. Return of goods: The Consumer must return the Product immediately, no later than 14 days from the day on which they withdrew from the contract, to the address: WikingTech, ul. Gradowe Wzgórze 30, 76-010 Polanów, Poland. The Consumer bears the direct cost of returning the item.
7.7. Liability for diminished value: The Consumer is only liable for any diminished value of the Product resulting from the handling of the Product other than what is necessary to establish the nature, characteristics, and functioning of the Product.
8. OPINIONS IN THE ONLINE STORE
8.1. The Online Store allows Customers to publish opinions about Products.
8.2. The Seller informs that it does not apply a verification procedure for opinions. This means that the Seller does not guarantee that the published opinions come from consumers who have used or purchased the product.
9. PROVISIONS CONCERNING ENTREPRENEURS (B2B)
9.1. This section applies exclusively to Customers who are not Consumers or Entrepreneurs with Consumer Rights (professional B2B trade).
9.2. The Seller's liability under the statutory warranty for Product defects (based on the Civil Code) is excluded.
9.3. The Seller has the right to withdraw from the Sales Agreement concluded with a B2B Customer within 14 days of its conclusion without giving a reason.
9.4. The Seller's liability towards a B2B Customer is limited to the amount of the price paid and delivery costs, not exceeding PLN 1000, and covers only typical foreseeable damages (lost profits are excluded).
9.5. The competent court for B2B disputes is the court having jurisdiction over the Seller's seat.
10. PERSONAL DATA (GDPR)
10.1. The Controller of personal data is WikingTech Damian Gendig.
10.2. Data is processed in accordance with the GDPR Regulation for the purposes of: order execution, Account maintenance, legal obligations (accounting), and marketing (if consent was given, e.g., Newsletter).
10.3. Detailed rules for data processing, including the rights of data subjects (access, rectification, deletion, restriction of processing), are contained in the Privacy Policy available in the Online Store.
10.4. Data recipients may include: carriers, payment operators, accounting offices, hosting providers.
11. REPORTING ILLEGAL CONTENT (DSA)
11.1. In the event that a User considers that content published in the Store (e.g., opinions) violates the law or the Terms and Conditions, they may submit a report electronically to the address: biuro@wiking.tech.
11.2. The report should contain an explanation of the reasons why the User considers the content to be illegal and the location of this content (e.g., URL link).
12. FINAL PROVISIONS
12.1. Agreements are concluded in Polish (or English for international customers, if applicable).
12.2. The Seller reserves the right to amend the Terms and Conditions for important reasons (e.g., changes in law). For orders placed before the amendment, the version of the Terms and Conditions in force at the time of ordering applies.
12.3. In matters not covered, the provisions of Polish law shall apply, in particular the Civil Code, the Consumer Rights Act, and the Act on Providing Services by Electronic Means.
12.4. These Terms and Conditions enter into force on 2026.01.01.
